The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Carlos S. Nino presentó en sus últimos trabajos una defensa de su teoría del castigo que incluía una profunda crítica al retribucionismo. Según su posición, si adoptáramos una teoría retribucionista del castigo, estaríamos asumiendo una versión del subjetivismo penal que abraza el perfeccionismo moral. Nino presenta esta idea sugiriendo que hay un vínculo estrecho entre el retribucionismo, el subjetivismo y el perfeccionismo. En este trabajo, voy a discutir esa relación y criticar el nexo que Nino cree que existe entre ellos. (...) The late Carlos S. Nino presented in his latest work a defense of his theory of punishment which involves a profound critic to retributivism. According with his position if we adopt a retributivist theory of punishment, in addition we are adopting a version of penal subjectivism that embrace moral perfectionism. Nino presents his idea suggesting that there is a chain that linked retribution subjectivism and perfectionism. In this paper, I will discuss the relationship between these three concepts and argue against the links that nino presents between them. (shrink)

In this paper we present an embedding of abstract argumentation systems into the framework of Barwise and Seligmans logic of information flow. We show that, taking P.M. Dungs characterization of argument systems, a local logic over states of a deliberation may be constructed. In this structure, the key feature of non-monotonicity of commonsense reasoning obtains as the transition from one local logic to another, due to a change in certain background conditions. Each of Dungs extensions of argument systems leads to (...) a corresponding ordering of background conditions. The relations among extensions becomes a relation among partial orderings of background conditions. This introduces a conceptual innovation in Barwise and Seligmans representation of commonsense reasoning. (shrink)

Dichos trabajos fueron discutidos por penalistas, filósofos y criminólogos de habla hispana provenientes de España, Argentina y Chile. En este sentido, el workshop ejemplificó también el tipo de acercamiento que los distintos mundos académicos, en este caso el mundo anglosajón y el hispano, o de forma más general el mundo jurídico del (...) common law y el de la tradición europea continental, están viviendo en estos días. Dung’s argumentation frameworks are formalisms widely used to model interaction among arguments. Although their study has been profusely developed in the field of Artificial Intelligence, it is not common to see its treatment among those less connected to computer science within the logical-philosophical community. In this paper we propose to bring to that audience a proof-theory for argument justification based on tableaux, very similar to those the Logic students are familiar with. The tableaux enable to calculate whether an argument or (...) subset of arguments are accepted or rejected in accordance to Dung’s preferred and grounded extension-based semantics. Soundness and completeness results regarding those semantics are provided. (shrink)

This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

Abstract‘Possibilist Explanation’ is a promising account of scientific explanation which avoids the familiar problems of “how-possibly explanations”. It explains an event by showing how-actually it was epistemically possible, instead of why it was epistemically necessary. Its explanandum is the epistemic possibility of an actual event previously considered epistemically impossible. To define PE, two new concepts are introduced: ‘permissive condition’ and ‘possibilist law’. A permissive condition for an event is something that does not entail the event itself, but a necessary condition (...) for it. A ‘Possibilist Law’ is a kind of scientific law that predicts that in the absence of a necessary condition N, the event E is not possible. Both PE and PL are legitimate and neglected parts of scientific knowledge and are especially suitable for human sciences. (shrink)

We reported a series of experiments carried out to confront the underlying intuitions of value-based argumentation frameworks (VAFs) with the intuitions of ordinary people. Our goal was twofold. On the one hand, we intended to test VAF as a descriptive theory of human argument evaluations. On the other, we aimed to gain new insights from empirical data that could serve to improve VAF as a normative model. The experiments showed that people’s acceptance of arguments deviates from VAF’s semantics and is (...) rather correlated with the importance given to the promoted values, independently of the perceptions of argument interactions through attacks and defeats. Furthermore, arguments were often perceived as promoting more than one value with different relative strengths. Individuals’ analyses of scenarios were also affected by external factors such as biases and arguments not explicit in the framework. Finally, we confirmed that objective acceptance, that is, the acceptance of arguments under any order of the values, was not a frequent behavior. Instead, participants tended to accept only the arguments that promoted the values they subscribe. (shrink)

Traditionally, in Spain bullfighting represents an ancient and well-respected tradition and a combined brand of sport, art and national identity. However, bullfighting has received considerable criticism from various segments of society, with the concomitant rise of the animal rights movement. The paper reports a survey of the Spanish citizens using a face-to-face survey during January 2016 with a total sample of 2522 citizens. The survey asked about degree of liking and approving; culture, art and national identity; socio-economic aspects; emotional perception (...) and animal welfare. The hypothesis proposed that the perception of bullfights may be affected by gender, age, occupation, origin and nationality of the persons surveyed. The hypothesis was confirmed. The majority of citizens surveyed do not like bullfights and great majorities do not attend or watch such events. Two extreme clusters were described: one representing favorable attitude towards bullfighting and other against bullfighting. The proportion of indifferent persons was important. Women and young people showed a more favorable attitude towards animal welfare issues associated with these events. Rural people were more accepting bullfights than urban people. Students were more anti-bullfight than those in other occupations. Additionally, technical economic factors made people favor more bullfights. The growth of claim against bullfights establishes an element of a far more multifaceted phenomenon that animal cruelty per se and support of a new paradigm called social change in countries as Spain. In this paper, we address the problem of truth approximation through theory change, asking whether revising our theories by newly acquired data leads us closer to the truth about a given domain. More particularly, we focus on “nomic conjunctive theories”, i.e., theories expressed as conjunctions of logically independent statements concerning the physical or, more generally, nomic possibilities and impossibilities of the domain under inquiry. We define both a comparative and a quantitative notion of the verisimilitude of such theories, and identify (...) suitable conditions concerning the (partial) correctness of acquired data, under which revising our theories by data leads us closer to “the nomic truth”, construed as the target of scientific inquiry. We conclude by indicating some further developments, generalizations, and open issues arising from our results. (shrink)

El liberalismo de Carlos S. Nino evolucionó desde sus primeros trabajos vinculados al derecho penal, hacia la construcción de una teoría de la democracia deliberativa. Desde sus comienzos, siguiendo a los autores liberales clásicos como John Stuart Mill, hasta el final en donde adhirió a un liberalismo igualitario, hubo construcciones que acompañaron este proceso, como el concepto de autonomía personal, y también ciertos ideales morales, como un oposición concreta al perfeccionismo. El texto presenta al liberalismo de Nino al comienzo y (...) al final de su obra para mostrar que el antiperfeccionismo originado en el liberalismo clásico que servía de base para construir su concepción de la autonomía, se mantuvo inalterado durante todo este proceso de evolución dificultando la compatibilización de su teoría de la responsabilidad penal con su teoría de la democracia deliberativa, orientada hacia el liberalismo igualitario. There are three concerns regarding Rachlin's altruism model. First, proximal causal mechanisms such as those identified by cognitive neuroscientists and behavioral neuropharmacologists are not emphasized. Second, there is a lack of clear testable hypotheses. And third, extreme forms of altruism are emphasized rather than common forms. We focus on an overarching theme – proximal mechanisms of individual differences in altruism.

El artículo expone dos visiones acerca de la legitimidad del castigo en contextos de exclusión social. En la primera parte, uno de los autores defiende la idea de que los Estados que incumplen con obligaciones legales previas no pueden inculpar a quienes cometan delitos vinculados con ese incumplimiento. No pueden hacerlo porque no tienen el estatus moral para hacerlo de acuerdo a dos objeciones: la de complicidad y la de hipocresía. En la segunda parte, la segunda autora critica esta solución (...) al sostener que la falta de reciprocidad que caracteriza a la relación política vuelve inaplicables las objeciones de hipocresía y complicidad al ámbito del castigo penal estatal. The purpose of this paper is to study the philosophical basis of the architecture of two Artificial Intelligence systems (AlphaGo and Hide and Seek). The problem considers the elucidation of the epistemological distinction between “knowledge” and “intuition” and questions whether the fulfillment of a programmed metric can be considered as a product of knowledge or, as an example of intuitive thinking. Through the analysis of both examples, it is shown that achieving the desired objective (winning a game of Go and (...) developing new hiding strategies) is not derived from the system’s architecture, but from the AI’s creativity to achieve the desired result; in that sense, it can be confirmed that certain intelligent systems are capable of creative and intuitive thinking. El objetivo del presente artículo es estu- diar los fundamentos filosóficos de la arquitectura de programación en dos sistemas de Inteligencia Artificial (AlphaGo y Hide and Seek). El problema dilucida la distinción epistemológica de los concep- tos “conocimiento”, “intuición” y “abducción”, para definir si el cumplimiento exitoso de una métrica programada, por parte de una computadora, es con- dición suficiente para atribuirle un comportamiento inteligente. A través del análisis de ambos ejemplos se muestran dos cuestiones: i) el cumplimiento exitoso de un objetivo programado ofrece nuevos recursos de conocimiento, ii) dichos conocimientos dependen de la ejecución de un programa cuyo pro- cesamiento es desarrollado por una IA y, por tanto, las operaciones superan las capacidades intelectivas humanas. Las conclusiones apuntan a que las com- putadoras son recursos de conocimiento especiales de comprobación de hipótesis. (shrink)

COVID-19 was recognized as a pandemic on March 11, 2020. Nine days later in Brazil, community transmission was deemed ongoing, and following what was already being put in place in various affected countries, restrictive and physical distancing measures that varied in severity across the different states were adopted. Adherence to restrictive and physical distancing measures depends on the general acceptance of public health measures as well as communities’ financial leverage. This article aims to explore and discuss ethical facilitators and barriers (...) to the implementation of physical distancing measures within three dimensions: political, socio-economic, and scientific. Furthermore, we would like to discuss ways to ethically promote restrictive and physical distancing measures in a large and unequal country like Brazil. There is an urgent need for transparent, consistent, and inclusive communication with the public, respecting the most vulnerable populations and attempting to minimize the disproportionate burden on them. Este ensayo aborda el tratamiento que Hobbes da a la complejidad de la causalidad en conjunción con su análisis materialista del modo en que el miedo orienta al sujeto en el tiempo con el fin de defender que para Hobbes el miedo es tanto una respuesta como una negación de la imposibilidad de la auto-soberanía. El ensayo argumenta que los movimientos de la memoria y la anticipación que Hobbes describe como centrales en la pasión del miedo transforman el campo causal (...) del sujeto de tal manera que le da un sentido de posible dominio tanto sobre sí como sobre el mundo que la rodea. Al sugerir que el miedo fomenta la ilusión de autonomía en la agencia de los individuos, Hobbes señala la posibilidad de que el inmenso y temible poder atribuido al soberano no sea simplemente una respuesta a la necesidad de sofocar el desenfreno y el desorden, sino también una condición para el sentido de cada individuo de su propia soberanía. O artigo busca elaborar um conceito de liberdade democrática como desenvolvimento de si, resistência à opressão e à injustiça epistêmica mediante engajamento crítico com as obras de Paulo Freire, Amílcar Cabral e Augusto Boal. No pensamento dos três autores, democracia, liberdade e desenvolvimento de si constituem uma tríade de mútua influência, de sorte que o pleno exercício de quaisquer desses itens é impossível na ausência de qualquer um dos outros dois. Trata-se de mostrar, além disso, a maneira pela qual a (...) opressão é compreendida nos trabalhos dos três pensadores como o oposto da liberdade, e a injustiça epistêmica, como uma dimensão psíquica da opressão. Este artigo pretende discutir a conexão entre a hermenêutica filosófica de Gadamer e a questão ambiental, enquanto uma espécie de eco-hermenêutica. Nesse sentido, busca-se discutir a contribuição do pensamento ontológico-prático de Gadamer em termos ecológicos, como um ramo da filosofia no qual as questões em torno do meio ambiente constituem um problema comum no âmbito da práxis humana. Apontando a crise ecológica como questão básica, Gadamer indica uma forma de pensar a própria constituição do modo de estar no mundo com (...) os outros, situado em uma esfera de práxis atual e cada vez mais degradada. Em uma palavra, ele oferece um horizonte interpretativo ao questionamento ecológico como um dos caminhos onde ainda se pode pensar a solidariedade hermenêutica em termos de solidariedade ecológica, como possibilidade de reabilitação da práxis desde o ambiente comum. In this paper we provide a compact presentation of the verisimilitudinarian approach to scientific progress (VS, for short) and defend it against the sustained attack recently mounted by Alexander Bird (2007). Advocated by such authors as Ilkka Niiniluoto and Theo Kuipers, VS is the view that progress can be explained in terms of the increasing verisimilitude (or, equivalently, truthlikeness, or approximation to the truth) of scientific theories. According to Bird, VS overlooks the central issue of the appropriate grounding of scientific (...) beliefs in the evidence, and it is therefore unable (a) to reconstruct in a satisfactory way some hypothetical cases of scientific progress, and (b) to provide an explanation of the aversion to falsity that characterizes scientific practice. We rebut both of these criticisms and argue that they reveal a misunderstanding of some key concepts underlying VS. (shrink)

Popper’s original definition of truthlikeness relied on a central insight: that truthlikeness combines truth and information, in the sense that a proposition is closer to the truth the more true consequences and the less false consequences it entails. As intuitively compelling as this definition may be, it is untenable, as proved long ago; still, one can arguably rely on Popper’s intuition to provide an adequate account of truthlikeness. To this aim, we mobilize some classical work on partial entailment in defining (...) a new measure of truthlikeness which satisfies a number of desiderata. The resulting account has some interesting and surprising connections with other accounts on the market, thus shedding new light on current attempts of systematizing different approaches to verisimilitude. Em Meu pensamento filosófico, Bertrand Russell afirma que a segunda filosofia de Ludwig Wittgenstein lhe parecia inteiramente ininteligível e constituída de doutrinas positivas triviais e de doutrinas negativas infundadas. Essas críticas ainda hoje são largamente consideradas como decorrentes do fato de Russell não ter compreendido as ideias tardias de Wittgenstein. Em oposição a esse julgamento, neste artigo argumenta-se que o diagnóstico póstumo de que Wittgenstein era autista suscita uma nova interpretação tanto de suas doutrinas positivas quanto de suas doutrinas negativas, (...) levando a uma revalorização do parecer de Russell sobre elas. Hans-Georg Gadamer é bem conhecido por sua abordagem compreensivista quanto aos problemas tradicionais da metafísica e filosofia em geral. Seu posicionamento teórico e crítico aproximam sua obra da tradição compreensivista iniciada em fins do século XIX e levada adiante a partir do início do século XX. Nesse trabalho, proponho uma breve discussão acerca de uma de suas comunicações nos anos 1960 em que o autor procura refletir e elucidar a situação da filosofia naquele contexto específico. Fim da Segunda Guerra Mundial, (...) industrialização endêmica e o progresso vertiginoso da técnica e da ciência podem ser apontados como fatores decisivos para a compreensão das características políticas, sociais e econômicas daquela época em particular. Intitulando sua comunicação “A posição da filosofia na sociedade”, Gadamer defende uma postura radicalmente diferente daqueles que se aproximam de visões de mundo totalizantes que poderiam ser justificadas a partir do ponto de vista da tradição hegeliana e, por outro lado, da postura subserviente, acrítica e iludida do que o autor chama de “philosophy of science”, herança da tradição positivista. Mesmo apresentados tendo-se em mente os problemas específicos daquele contexto, os argumentos de Gadamer podem ser utilizados como uma ferramenta razoável para a compreensão de nossos próprios problemas, especialmente quando a tarefa é discutir e compreender criticamente a posição da Filosofia em nossa cultura. Procuro refletir sobre essa comunicação de Gadamer ajustando o foco para a relevância dele para a compreensão da situação da Filosofia no contexto cultural e acadêmico brasileiro. (shrink)

El objetivo general del presente trabajo es elaborar una lectura pedagógica de Filosofía de las formassimbólicas, de Ernst Cassirer, centrando la atención en el volumen Fenomenología del conocimiento, donde el autordetalla que los fundamentos aducidos por Paul Natorp, en Introducción a la psicología constituyen una visióncrítica de la psicología como fundamento de las operaciones intelectuales. En general, son tres los resultados amostrar: primero, que esta recuperación de la visión natorpiana permite a Cassirer sostener que toda actividadcultural (el lenguaje, la mitología, (...) el arte, la ciencia, etc.) tiene como fundamento las actividades psicológicas delsujeto, lo que implica que toda formación simbólica es, tanto un producto intelectual del individuo como unaactividad cultural; segundo, que para el desarrollo de una psicología crítica, de acuerdo con al plan general deNatorp, es necesaria una teoría de la formación que explique cómo el entorno cultural conforma las actividadesintelectuales del sujeto, tesis general asumida por Cassirer para el desarrollo de su teoría del símbolo; finalmente,que los agentes formativos culturales considerados por Natorp para la formación del individuo (Estado, artey religión, principalmente) constituyen las bases teóricas de la cultura, en las que posteriormente el alumnodesarrollará su teoría del lenguaje, mito/religión, arte y ciencia como formaciones culturales. O presente artigo perscruta o modo dialético pelo qual Sartre, desde os anos 1960, aclimata a vida psíquica e o vivido. Para esta lida, realizaremos uma incursão investigativa sustentada por um conjunto de escritos sartreanos deste período, dando especial enfoque sobretudo ao ensaio Questões de método (1957) e à conferência que nosso autor profere em 1961, e cujo título, Marxismo e subjetividade, é revelador da sua tentativa de conciliar o existencialismo e o materialismo histórico à luz de uma dialética existencial. Na sequência, mostramos como a dialetização da vida psíquica, que pressupõe uma antinomia dialética (presença a si e ausência de si), enseja, por parte do filósofo, uma crítica pontual à psicanálise freudiana.
